General Terms and Conditions of the Company

We only work under our standard terms and conditions.


1 Offer / Order / Contract


1.1 Conclusion of contract: The presentation of our products in the store, online shop or catalog does not constitute a legally binding offer, but a non-binding catalog. In the medical prescription area, the contract law of the health insurance company applies, as do additional individual contracts for value-added items and additional work. Orders become valid and binding upon signature. Amounts not covered by health insurance companies must be paid by the customer themselves after the invoice has been issued. By clicking the "Confirm order" button in the online shop, you place an order for the goods in the shopping cart. Our products are only sold for private use in normal household quantities. Confirmation of receipt of the order follows, for online orders, immediately after the order has been sent. The purchase contract is not concluded with our order confirmation, but only with delivery of the goods or an order confirmation. The contract text is saved. The situation is different in the store. Here, orders are considered binding (craft services) including ancillary agreements. There is an obligation to accept and pay. If the prescription cannot be billed within the legally specified time frame, the order will be billed 100 percent privately to the customer. You can view the general terms and conditions at any time and save them to your computer or print them out. Your online order data is saved, but cannot be accessed via the Internet for security reasons. An order confirmation will be sent to you by email after you have ordered online. You have the option of changing or canceling this order at any time, or having the order or the contract text sent to you again upon request. Email (info@hoecker-orthopaedie.de).

1.2 We accept orders for goods verbally (by telephone), in writing (fax, e-mail, letter) and online via our internet shop. We reserve the right to make technical and design deviations from the information and images in catalogues or in our internet shop. Individual orthopedic services such as insoles cannot be exchanged and are only accepted, adjusted and delivered on site.


2. Prices


2.1 The prices stated on the product pages or in the store include VAT and other price components and are exclusive of postage.


3. Payment


3.1 Craftsmanship services provided in the shop are payable immediately upon completion. For online orders, we deliver against invoice, cash on delivery, advance payment, payment by credit card plus postage. To protect against credit risk, we reserve the right to exclude certain payment methods and only deliver against cash on delivery or advance payment. For goods that have been modified or manufactured to customer specifications, we reserve the right to only deliver the goods after a deposit has been paid or against advance payment. Special services, such as the preparation of cost estimates, are invoiced separately. For all payment methods except "advance payment", the delivery address and billing address must be the same. The payment options vary depending on the country. We only charge credit cards on the day the goods are delivered.


3.2 Goods sold on account must be paid immediately after delivery, without deduction.


3.3 If the buyer defaults on payment, he shall pay interest on the outstanding claim during the period of default at the usual bank rate of 5% above the base interest rate pursuant to Section 1 of the Discount Rate Transfer Act of June 9, 1998 (Federal Law Gazette I, p. 1242).


4 Delivery


4.1 Depending on the delivery method selected, different delivery times are to be expected. We will endeavour to process your order quickly. We will inform you of any delays in delivery by email. On-site workshop customers will be informed twice by telephone of completion, and then once in writing if they are not available. If there is no customer response, we will charge 100% of the service.


4.2 For online orders, shipping costs are calculated in our shop system and displayed before the order is placed.


5 Retention of title


5.1 The goods remain our property until full payment has been made.


6 Warranty


6.1 The warranty is provided in accordance with the statutory provisions. Special regulations apply to services provided by statutory health insurance providers, which you can inquire about from the relevant insurance provider.


7 Data protection

7.1 We treat all your personal data confidentially. To process your enquiries and orders, we require at least your name, address, email address and delivery and invoicing information.


7.2 We use your inventory data exclusively to process your order. All customer data is stored and processed by us in compliance with the relevant provisions of the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). You have the right to free information, correction, blocking and deletion of your stored data at any time. Please contact info@hoecker-orthopaedie.de or send us your request by post. We will not pass on your personal data, including your home address and email address, to third parties without your express consent, which can be revoked at any time. Excluded from this are our service partners who require the transmission of data to process the order (e.g. the shipping company commissioned with the delivery and the credit institution commissioned with the payment processing). In these cases, however, the scope of the data transmitted is limited to the minimum required. We use technical and organizational security measures to protect the data we manage against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Personal data is transmitted encrypted (128-bit SSL).


7.3 Note on cookies: Cookies are necessary for interactive shopping via the Internet in our shop. We use this technology exclusively for your purchases in our shop. A random number is generated that is saved in a file called a cookie during your purchase. As soon as you leave our website, the cookie is deleted. You can manage the acceptance of cookies from our site in your browser and block them if necessary (in this case the order will not work).


8 Place of jurisdiction


8.1 All differences of opinion and legal disputes arising in connection with the business relationship shall be governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods. In the event that the customer does not have a residence or habitual abode in Germany when the action is brought, or if these are not known to Orthopädieschuhtechnik Höcker and/or the customer is a merchant, Bielefeld is agreed as the place of jurisdiction.
